The process of making a claim is quite straightforward however every claim is treated on a case by case basis, but below is a generalised summary of the lifespan of a personal injury case.
STEP 1: Get in touch with us. Our trained receptionists will take basic details, which will then be passed on to one of our legal team (or one of the legal team will consider your online notification form)
STEP 2: You will be contacted by one of our experienced team members in the personal injury department to obtain more information, and confirm if we are able to help. There will be no obligation on you to make a claim.
STEP 3: If we are able to help you will be invited in for a meeting at our offices for a detailed discussion of your case and the funding of it. You will be spoken through and given a copy of the ‘No Win No Fee Agreement’. If you are unable to attend our offices for any reason we will, if appropriate, have discussions by way of telephone or arrange a home attendance in special circumstances.
STEP 4: After the meeting a Senior Solicitor will review the report of the meeting and proceed with sending a letter to the opponent making your Complaint/Claim.
STEP 5: The Defendant will have 21 days to acknowledge this letter, and 3 months thereafter to provide their formal response.
STEP 6: We will enter into discussions and negotiations with the opponent in an attempt to settle your claim including trying to obtain any documents, CCTV or other evidence in the possession of the opponent that we think might help your case and also discuss with you whether there are any witnesses or any other evidence that we need to collect on your behalf to take the case forward, including evidence of your injuries.
STEP 7: We will keep the case under review and if at any stage we decide that you are unlikely to succeed with the case, we will advise you of that (and close your file- in these circumstances you pay nothing).
STEP 8: If it is not possible to settle the case by negotiation with your opponent ,and we think your case is a strong one that should be taken to Court, we will issue proceedings for you in the appropriate Court claiming compensation and pursue the case through the Court for as long as we believe that you have a reasonable chance of winning the case.
The outcome we are always working towards is securing you compensation for your losses.
No. We work on a no win, no fee basis. If you do not win your claim, you’ll pay nothing to anyone – it is as simple as that.
The only condition where this could be affected is if you have been dishonest in what you have told us and have refused to follow our advice.
Whilst there can also be rare exceptions to our no win no fee agreements, you will be advised of these before your claim starts.
In most cases, you will have three years from the date of your accident.
There are some circumstances where different rules apply, and our team will be happy to discuss these with you.
For example, if you were under 18 at the time of your accident the three year window will only begin on your 18th birthday.
