Experienced Military Law and Court Martial Lawyers
The Court Martial is the military’s highest court for dealing with allegations of breaches of service law allegedly committed by members of:
The Army
The Royal Airforce
The Royal Navy
Facing court martial proceedings can be a challenging and daunting experience, where service personnel face the prospect of losing their careers as well as their liberty.
Court Martial proceedings are often preceded by an interview with the Royal Military Police, and therefore expert advice from the earliest stages of proceedings is key to achieving a successful outcome.
Our team has extensive experience in Military Law, including representation throughout investigations by the Royal Military Police. We represent service people before Court Martial tribunals at Bulford and Catterick Garrison as well as in Episkopi Cyprus. We also provide expert advice with appeals. We are committed to providing clear, strategic guidance, helping clients and their families understand the legal process and the options available to them.
Notable Cases
R v P – Soldier accused of a fight following a mess party. The defendant faced a situation where 5 prosecution witnesses claimed that he was the aggressor in the fight. We successfully highlighted the close links between all the prosecution’s witnesses, exposed the inconsistencies in their accounts, as well as demonstrating the complainant’s history of drunken allocations and finding independent witnesses who described the complainant as the aggressor. This led to our client being acquitted by the Court Martial board at Catterick Garrison.
This case highlighted the stark nature of Court Martial proceedings – our client was a well-respected soldier on the brink of further promotion. These proceedings had led to that promotion being delayed, and his acquittal allowed his promising career to proceed whereas conviction would have seen him imprisoned and dismissed from the service.
R v M – Soldier accused of GBH while on leave from the army. We were able to successfully secure our client’s acquittal after successfully advancing self-defence relying heavily on evidence from our client’s military record and evidence from his commanding officer which demonstrated that even in violent and stressful situations, he was capable of weighing the force needed and making reasoned decisions.
