Funding Your Case
There are a number of different ways to fund your case.
Public funding
If you are in receipt of certain benefits or are in receipt of a very low income, you may qualify for public funding. Should we take on your case, we will be able to assess if you are eligible for public funding.
BTE (Before the event insurance) / LEI (legal expenses insurance)
We can investigate whether or not you have any insurance already in place which could cover your legal costs of bringing a claim. If you have such cover, then your insurance company could agree to pay the legal costs of a claim. We can advise you on this should it be relevant in your case.
CFA
In certain circumstances, we can offer a conditional fee agreement to clients if they do not qualify for public funding and they do not have BTE / LEI cover. If we agree to enter into such an agreement with you, it will mean that we share the risks of the case with you. Whilst you will not be asked to pay any solicitor costs up front, a deduction can be made from any damages awarded to you as a contribution towards the costs incurred on your case.
ATE (after the event) insurance
This could be relevant if you do not have BTE / LEI insurance and we offer you a CFA. This is an insurance policy which covers costs you may be ordered to pay to a Defendant as a result of bringing your claim. We can advise you further on this as and when this becomes relevant.
Private Paying
If no other funding arrangement is available, we may agree to act for you on a private paying basis. This will be based on an hourly rate plus VAT for any work we do on your behalf and the hourly rate will depend on the level of experience of the solicitor dealing with your case. We can provide further details should this funding arrangement be adopted.
Our Approach
We recognise that our clients are bereaved and often cannot find closure until the inquest process has concluded. We pride ourselves on building a relationship of trust with each and every client and we always strive to obtain as many answers as we can to questions surrounding the death of a loved one.
In terms of judicial review matters, these are by their nature complex with tight deadlines so we strive to fully advise clients on these difficulties to best achieve their desired outcome.
We aim to provide a flexible and tailored service, providing advice over the telephone, via email, and in person. Where appropriate, the team can travel to see clients in prison, in hospital or at home. Appointments to see a member of the team generally take place in one of our offices.
The Public Law team works closely with the Actions against the Police and public authorities and Civil Liberties team at GT Stewart Solicitors. The teams are experienced and skilled to recognise the connections between these areas and are able to refer any matters to the relevant department to ensure that you are provided with a full service that is suited to your needs.
