Our client approached us as she was facing possession proceedings due to significant rent arrears. She struggled to understand bills and finances. We arranged an expert assessment which found that our client’s learning disabilities were so severe that she lacked capacity to litigate and/or manager her finances. We approached the Official Solicitor to act as Litigation Friend. We also made an application for Discretionary Housing Payment which was successful and the arrears were substantially reduced. Our client was also able to make regular payments towards her rent and the remaining arrears. The possession proceedings were therefore adjourned and our client did not lose her home.
