GTS today persuaded the Crown Prosecution Service [CPS] to discontinue a charge of criminal damage against our client JR.

JR faced one allegation, namely that she damaged property said to belong to her neighbour. Both parties were engaged in a dispute regarding land boundaries; JR removed a post installed by her neighbour, which prompted a complaint to the police.

JR denied the allegation and maintained land on which the post was installed belonged to her. GTS obtained a report from a surveyor, which confirmed the land did indeed belong to her, and formal representations were submitted to the CPS on the basis the relevant evidential stage of the Code for Crown Prosecutors was not met.

Had JR been convicted, she would have lost her career as an optometrist.

Having considered the representations, the CPS duly discontinued the charge against JR.
