We acted for this tenant of a local authority with a long and very difficult history of ASB related in large part to her mental health and to her violent ex partner’s attacks on her at the property. We successfully defended possession proceedings brought by the local authority on a mandatory ground, settling these by getting her a new allocation of accommodation in a safe area within the borough. Our client’s health had deteriorated due to her HIV and she was awaiting a lung transplant. She was also pregnant.
The complexity of the case and her housing needs made it challenging to achieve settlement. The case had been going on in different courts for around 8 years before settlement. For the same client we issued and won a JR because the local authority refused to accept a homeless application from her. The JR included a successful urgent application to get our client accommodation pending the outcome of the homeless case.
