UK Commercial Property and EPC Ratings: What Does the Future Hold?
Energy efficiency is becoming an increasingly important consideration for commercial property owners, investors and occupiers. Whilst Energy Performance Certificates (EPCs) have been a feature of property transactions for many years, they are now playing a much greater role in determining whether commercial premises can be lawfully let and how they are to the market.
An EPC provides a rating from A to G based on building's energy efficiency. Under the current Minimum Energy Efficiency Standards (MEES), most commercial properties in England and Wales must achieve a minimum EPC rating of E before they can be let, unless a statutory exemption applies.
The direction of travel is clear. The Government has announced proposals that would require larger privately rented commercial buildings to achieve an EPC rating of B by 2031, subject to certain exemptions and cost-effectiveness criteria.
For commercial property owners, the implications extend beyond regulatory compliance. Buildings with poor energy performance may become less attractive to tenants, require significant capital expenditure to improve efficiencey and, in some cases, experience a reduction in value. Conversely, energy-efficient properties are increasingly viewed as more resilient long-term investments.
Landlords should therefore consider reviewing their existing property portfolios, identifying assest that may fall short of future requirements and taking early advice on any legal, leasing or funding implications arising from proposed improvements.
As sustainability continues to shape the commercial property market, EPC ratings are likely to become an even more significant factor in acquisitions, disposals, asset management and lease negotiations. The most prudent property owners will be those who prepare now rather than wait for further regulatory change.
