We represented AL who was charged with two offences of assault by beating. He was a man of good character.
We instructed an independent psychiatrist, Dr Tim Rogers, who confirmed that at the time of the alleged offence, AL was suffering from poor mental health.
On this basis, we made written representations to the Crown Prosecution Service that it was not in the interests of justice to proceed with the prosecution of AL.
The Crown Prosecution Service subsequently discontinued the proceedings and AL remains of good character.
