JBM had lived with and cared for his father since 2013. After his father died, JBM made an application to succeed his father’s tenancy but this was refused by Lambeth. Lambeth went on to issue possession proceedings in April 2022 against JMB for unauthorised occupancy.

JBM’s defence was filed and served and based on public law grounds, alleging that Lambeth had not  considered JBM’s request for a discretionary tenancy, and they had failed to exercise reasonable discretion for allocating a discretionary tenancy, in accordance with Lambeth’s own allocation policy. Case management directions were given in the case.

Following the exchange of evidence/disclosure in the case, Lambeth then decided to discontinue proceedings altogether.
