Our Birmingham office (McGrath & Co Part of GT Stewart Solicitors) has developed a reputation for opposing gang injunction applications, and have marked up another success in defending a young man, against whom the Police sought an injunction, with draconian conditions (area exclusion and extensive non-association etc), under Part 4 of the Policing and Crime Act 2009.

After a 5 day trial, the Judge refused the application on the basis that the applicant had failed to persuade the Court that an injunction against the respondent was necessary and, the respondents disability (Autism & ADHD) meant that granting an injunction against him would be indirectly discriminatory, unjustified and therefore not proportionate.

Particular congratulations to trainee solicitor, Katie Lockhart who, along with Head of Department, Errol Robinson, and outstanding representation by counsels Jonathan Manning and Charlotte Crocombe of 4-5 Gray’s Inn Square, left no stone unturned to achieve this fantastic result (much to the displeasure of West Midlands Police).
