    Crown forced to offer no evidence in serious assault occasioning actual bodily harm at Wimbledon Magistrates’ Court

    GT Stewart represented BS who had been charged with a serious offence of assault occasioning actual bodily harm. BS relied upon the defence of self defence. At Court, the prosecution made an application to adjourn the trial as the complainant was unwell and had not attended Court. We opposed the application and after considering the submissions we made on BS’ behalf, the Court refused the prosecution’s application to adjourn. As a result, the prosecution was forced to offer no evidence against our client and a formal not guilty verdict was recorded by the Court. If he had been convicted of this offence, there was a significant risk that BS would have been sentenced to an immediate custodial sentence.
