GT Stewart persuades Council to withdraw review decision after misapplication of policy web

Our client had received a Notice Seeking Possession from her council landlord based on grounds of anti-social behaviour and rent arrears. Our client has a severe mental health condition and the allegations of anti-social behaviour arose as he was exploited by unwanted visitors attending his property. In addition, he was not aware of his service charge obligations which had led to the rent arrears. We encouraged our client to engage with social care and support services. As a result there was no further reports of anti-social behaviour and our client was able to secure deductions from his Universal Credit to pay towards the service charge and arrears. We made representations to the council that in light of the developments since service of the Notice, it would not be reasonable or proportionate to seek possession.  The council accepted this and confirmed they would not be pursuing possession.
