GT Stewart Solicitors & Advocates represented a child, aged 14, who was facing an allegation that he breached a gang injunction.  The Local Authority alleged that our client breached the injunction by being in the company of 4 other children, in a public place, when the group assaulted a male by throwing bottles at him and causing injury to his arm.  Our client entered a not guilty plea and the case was listed for a two day trial at Leeds Magistrates’ Court.   The evidence consisted of statements from police officers who allegedly identified our client from poor quality CCTV footage.    The footage did not show an assault nor did it show our client throwing bottles which caused the victim an injury.  The case was fully prepared for trial with Patricia Walker, who represented the child, taking great care to explain the evidence in the case, the law and court procedure, to ensure that he fully understood the case against him.    Two weeks prior to the trial the Local Authority withdrew the case against our client.  Had our client been convicted, the Local Authority were seeking a Supervision or a Detention Order.
