We represented DL, a young man charged with being in charge of a vehicle whilst under the influence of drugs.
DL relied upon the statutory defence to this offence - that there was no likelihood of him driving whilst under the influence of drugs.
The prosecution relied upon police body worn footage to support their case which showed DL with his helmet on and the vehicle engine running.
We challenged this evidence at trial and the Court agreed that on the balance of probabilities, we had shown we would not drive the vehicle whilst under the influence of drugs and DL was found not guilty.
