We represented a vulnerable mother of previous good character who had been charged with an offence of child cruelty. On our consideration of the evidence in the case, it was our view that there was no evidence to suggest that our client had wilfully exposed her child in a manner likely to cause unnecessary suffering or injury. To the contrary, our client had sought assistance and support and took steps to ensure that her child received the care that they needed.

At our client’s Plea and Trial Preparation Hearing, we confirmed that we intended to make an application to dismiss the charge against our client. Although the Crown later amended the indictment, we proceeded with our application to dismiss. After considering the submissions that were made on our client’s behalf, the Court dismissed the case against our client and she remained a person of good character.
