“Insightful assessment of a complex situation. My son and I were fortunate enough to have Ness allocated to us to represent my son (28) who has a complex learning disability. The challenge was surrounding my son’s capacity to understand the legal process and if he had from the beginning. As a parent I had challenged the police and stated he did not have capacity in complex information or decision making. Ness recognised that my son has a significant impairment and questioned if he should have been interviewed at all. This insight has halted/stopped a process which should have been picked up sooner.
