The court decided to stay the proceedings with liberty to apply to restore on notice, including if and when the Portuguese court requests English court to do so, or orders that child’s custody should be with the father, or orders child’s return to Portugal. Working with Michael Gration KC (4PB Chambers). Read here – https://vlex.co.uk/vid/g-v-h-946048060
  • KH v MB [2023] EWHC 3194 (Fam) – The court ruled that the child’s habitual residence was not in England and Wales at the time of his removal, but rather in Morocco. However, due to compelling circumstances and the best interests of the child the court exercised its parens patriae jurisdiction and ordered child’s return from Algeria to England and Wales.
