We represented a woman of previous good character who had been charged with dangerous driving. It was the Crown’s case that following a night out, our client drove her vehicle dangerously causing serious injury to another. The Crown Prosecution Service authorised a charge a year and a half after the incident took place, deciding to proceed with a victimless prosecution and relying heavily on comments that our client allegedly made at the scene. At our client’s first appearance, we raised concerns that there was no evidence that our client had in fact committed a criminal offence at all. The Crown however, maintained that the case had been reviewed and that the matter would proceed. Our client’s case was sent to the Crown Court.

At our client’s Plea and Trial Preparation Hearing, we invited the Court to list the matter for an application to dismiss and, shortly after the hearing, we made written representations to the Crown Prosecution Service in which we argued that they had insufficient evidence to provide a realistic prospect of conviction. After considering the representations made on our client’s behalf, the Crown Prosecution Service offered no evidence against our client. A formal not guilty verdict were recorded and our client remained a woman of good character.
