We represented a client who had been charged with offences of theft and handling stolen goods. It was the Crown’s case that our client and others had stolen a high value vehicle from the complainant’s driveway. Our client was stopped by the police in the vehicle 6 minutes after it had been reported stolen. In his police interview, our client denied the offences in their entirety. We made written representations to the Crown in which we argued that they had insufficient evidence to prove their case, however, they maintained that they were proceeding with the case against our client.
At trial, the significant failures in the police investigation were highlighted through cross examination of the officer in charge of the case. Our client gave evidence in his defence and after deliberating for just over an hour, our client was unanimously acquitted by the jury.
