We represented a client who had been charged with an offence of sexual assault by penetration. Our client denied the allegation from the outset and said that any sexual activity that took place was entirely consensual. As a result of the Crown Court back log, our client was on Court bail for two years for what was already a historic allegation. The complainant attended Court to give evidence and our client gave evidence in their defence. After deliberating for just over an hour, our client was unanimously acquitted by the jury. The Crown subsequently applied for a Restraining Order on acquittal which was opposed. After considering the submissions made on our client’s behalf, the Court refused to impose the Order.
