We represented a client who had been charged with an offence of possession of an offensive weapon. The Crown alleged that our client had been involved in a heated confrontation with two other males whilst in possession of a baseball bat. The Crown relied on the evidence of two police officers who claimed that they had witnessed the confrontation. Our client denied this offence and raised the defence of good reason.
At trial, the two police officers gave evidence and were cross examined on the basis that they hadn’t seen a confrontation at all and that they had simply made a number of assumptions about our client. Our client and our client’s defence witnesses gave evidence and following lengthy closing submissions, the Court found our client not guilty.
