C appeared before Leeds Crown Court in relation to two offences of Theft. He had pleaded Guilty to these offences at an appearance before Leeds Magistrates Court and was committed to the Crown Court for sentence as these offences placed him in breach of a Crown Court Suspended Sentence Order. The law requires that any person who commits further offences whilst subject to a suspended sentence order must be sent to prison unless it would be unjust to do so.
C was represented in the Crown Court by Philip Mahoney of GT Stewart’s Leeds Office. He took careful and detailed instructions from the client, and was consequently able to provide the court with sufficient information to persuade the Judge not to activate the suspended sentence. Instead, the duration of the suspended sentence order was extended, and C was sentenced to fines for the Theft offences.
