We represented Mr Berry in an application for an injunction brought by his Landlord Southern Housing Group. There was a neighbour dispute between Mr Berry and two of his neighbours. Serious allegations were being made on both sides. His Landlord, Southern Housing Group (SHG)decided he was the problem and applied for an injunction on a without-notice basis. The application was supported by a witness statement of a housing officer. The injunction was granted in Mr Berry’s absence and a power of arrest attached. SHG had failed to provide the Court with material information within its without notice application such as the fact there had been counter allegations and relevant health issues. We sought to discharge the injunction and at hearing the Judge agreed observing that he did not consider this to have been an appropriate case for a without notice application in the first place.
