We represented one of three young people charged with an offence of allowing to be carried. Prior to our client’s trial, we made representations to the Crown that they did not have sufficient evidence to prove their case. They maintained that they were proceeding with the trial and that it was a matter for the Court. After the prosecution had presented their case, we made submissions that our client had no case to answer. We argued that the Crown had no evidence that our client had committed an offence at all. After considering our submissions, the Magistrates’ agreed and dismissed the case against our client. A formal not guilty verdict was recorded.
