GT Stewart Solicitors represented HA, a very vulnerable young man who was alleged to have breached his Community Order by the probation Service. Having seen how badly the order had been managed we argued that the hearing should be postponed for GT Stewart to challenge the probation services’ decision to prosecute HA in light of his vulnerability and the poor management of the Order by the probation service. The Court agreed. We challenged the decision to prosecute the breach by way of written representations to the Probation Service and argued that the Community Order should be revoked in its entirety. After considering our representations, the Probation Service agreed to withdraw the breach. The Court revoked the Community Order and resentenced HA to a conditional discharge, meaning that no immediate punishment was imposed.
