
Our client was recalled to the hospital three years ago after facing difficulties in their previous ward. Given these challenges, they were transferred to an assertive rehabilitation unit, where significant work was undertaken to facilitate a safe conditional discharge.
Following an extensive search, a suitable specialist community accommodation was identified. With the necessary support in place, the client successfully transitioned, settling in, and integrating well into their new environment.
As part of the client’s discharge plan, a clinician proposed a condition requiring the client to completely abstain from alcohol for their release into the community. However, we successfully argued for a relaxation of this condition, demonstrating that the associated risk was historical and that moderate alcohol consumption is a common aspect of social engagement for many people. We demonstrated the progress that our client had made since his index offence and that he could safely transition into the community.
The Tribunal confirmed that our client no longer required inpatient treatment and that he could be safely cared for in the community and his conditional discharge was ordered. With a clear plan in place, our client has now reintegrated into the community and is optimistic about his future.
