Successful challenge by Sophie Smith to the CPS’ decision to prosecute our client for a Public Order offence rather than caution him. The CPS refused to reconsider their decision on at least two occasions and it was only after an application for permission to judicially review their decision was issued at the Administrative Court with the assistance of Maya Sikand of Garden Court Chambers that the matter was properly reviewed. Following this review, a caution was agreed as the correct course of action with the CPS’ agreeing to pay our client’s reasonable legal costs.
