Sarah Memmi of GT Stewart Solicitors & Advocates represented N who was facing four charges: assault by beating, criminal damage, obstructing / resisting a constable in the execution of their duty, and assault by beating of an emergency worker. Sarah successfully opposed the prosecution’s application for an adjournment, forcing the prosecution to offer no evidence on the first two charges.
Following cross-examination, the District Judge found that the officers had effected an unlawful arrest and unlawfully used force against N, therefore they had not acted in the execution of their duty and N had acted in lawful self-defence. N was acquitted of the two remaining charges.
