GT Stewart Solicitors & Advocates represented S in respect of a domestic assault involving his partner. On the day of the trial the prosecution intended to rely on the complainant’s 999 call to the police and police body-cam footage due to the fact that the complainant failed to attend the trial to give evidence in her case. The 999 call and body-cam footage was highly prejudicial to S as it contained the full account given to police by the complainant.
We argued that both the 999 call and body-cam evidence should be excluded as it would have been grossly unfair in the circumstances to introduce the evidence, as the complainant was not at Court to be cross-examined. The Court were persuaded to exclude the evidence and the prosecution were forced to offer no evidence against S, who was then found not guilty of the allegations.
