Education Law

Many people, children and adults, experience difficulties during their education and there are times when expert legal advice or representation can make a real difference in navigating this complex area of law.

Decisions made by schools, colleges, universities and local authorities may not always be lawful.

At GT Stewart our specialist education and SEN lawyers have a wide range of experience in providing advice and assistance for parents/carers and young people who need help with education issues. We are a socially inclusive practice and represent clients from all walks of life and types of education; independent and state, mainstream and alternative.

Your child may have special educational needs and be having difficulties in accessing the right provision; or your child might have been unfairly excluded or not have a place at the school of your choice.

You might have a dispute with your university or education provider regarding the service you have received.

We appreciate how stressful and upsetting it can be to find yourself in any of these situations, and our team of dedicated, caring lawyers are here to help. We will listen to your concerns so that we gain a thorough understanding of you and your child’s unique circumstances.  We will then help you to understand how the law can work for you, and what steps we advise to resolve the matter.

We focus on finding a resolution as quickly as possible, without the need for formal legal action, unless it is appropriate to do so to secure the positive outcome you desire.

Examples of the kinds of issues we can help with are:

  • Special Educational Needs
  • Appeals and Tribunals
  • Judicial Review
  • School Admissions and Exclusions
  • Complaints against a Local Authority or School
  • Discrimination
  • Bullying
  • School transport, school funding and other issues
  • Higher Education
  • Student finance

Legal Aid is available for a range of civil work, and for education matters that involve potential judicial review proceedings.  To qualify for Legal Aid we will carry out an assessment of your income and capital as well as the prospects of success of your case. The Legal Aid Agency provides an online calculator which you can access direct to determine whether you may be eligible http://civil-eligibility-calculator.justice.gov.uk.  We will help you through the Legal Aid Application process and if you are not eligible for free legal advice, or it is not available for your situation, we can provide a number of other funding options including:

  • Conditional Fee Agreement ( CFA)
  • Fixed fee/staged payments
  • Hourly rate private fee scheme
