DI was charged with assaulting an emergency worker following an arrest to prevent a breach of the peace. DI was represented by Ed Youlton of our Leeds office at the police station, Magistrates’ Court and Crown Court.
Mr Youlton identified issues with the lawfulness of the original arrest to prevent a breach of the peace at the outset of the case and so requested the body worn video footage in order to examine the police’s conduct towards DI. This led to the Prosecution offered a lesser charge of resisting a police officer in the exercise of their duties as an alternative to DI. However, he maintained his denial of any unlawful conduct and entered a not guilty plea. This led to the Prosecution offering no evidence against DI.
