GT Stewart Solicitors represented PS who was arrested and taken to Grimsby Police Station, where he was interviewed on suspicion of intentionally strangling his partner, assaulting her by banging her head on the floor and making threats to kill her.  After receiving disclosure from the police, PS was advised to put forward his account in the form of a prepared statement, namely, that the complainant account was false and that she had made false allegations against him on previous occasions, which had been reported to the police.

PS was charged with two offences of Assault Occasioning Actual Bodily Harm and Making threats to kill and he was remanded into custody at Grimsby Magistrates’ Court.  The Crown made a bad character application and after confirming that they had ‘evidential issues’ made an application for a witness summons to ensure that the complainant attended the trial to give evidence against PS.

Just seven weeks before the trial date, the CPS requested the case to be listed for a mention in order to offer no evidence.  Not guilty verdicts were recorded and PS was released from custody.
