GT Stewart acted for N, a female of good character, who was charged with intentionally obstructing cabin crew following an incident on a flight from the Caribbean to Birmingham. N was alleged to have argued with a fellow passenger and was arrested upon landing at Birmingham Airport.
In interview, N accepted arguing with the passenger and expressed her remorse at the incident. Despite being provided with assurances she was eligible for a Simple Adult Caution, a Police Inspector decided to charge her and instigate court proceedings.
GT Stewart were first instructed by N at the magistrates’ court. The proceedings were adjourned in order that written representations could be submitted to the Crown Prosecution Service arguing that the proceedings ought to be diverted back to the police station in order for NW to be issued with a simple adult caution.
Despite strong opposition from a West Midlands Police Inspector, the CPS accepted the representations, N was issued with a simple adult caution and the court proceedings were discontinued.
