GT Stewart Solicitors represented JH who appeared before Leeds Magistrates’ Court charged with an offence of driving a motor vehicle whilst unfit through drugs. JH was represented by Michelle Stewart who noted that JH had been charged under the old legislation of driving whilst unfit, which of course requires evidence of impairment, rather than with driving whilst over the prescribed limit, which only requires a positive blood sample. We made representations to the prosecution that they had to prove the newer legislation rather than the offence for which he had been charged. It was noted that statements provided by police officers confirmed that there was no evidence of driver impairment. The prosecution were forced to withdraw the charge after they realised that they were out of time to amend the charge to the new legislation.
