The Local Authority landlord issued a Notice Seeking Possession in reliance on grounds of rent arrears and alleged anti-social behaviour. We took client’s instructions in relation to the allegations and also considered the housing file. We considered that many of the allegations raised were irrelevant and did not amount to a breach of tenancy, by our client. We also considered the Local Authority had failed to have due regard to their duties under the Equality Act 2010. We wrote to the Local Authority making representations in support of our client’s case. In response to our representations they confirmed that they would not proceed with the possession proceedings, and our client retains his home.
