GTS represented AC who was charged with stalking involving serious alarm and/or distress, contrary to section 4A of the Protection From Harassment Act 1977. It was alleged that she harassed her ex-partner by following him, turning up at his place of work and social events, and setting up fake social media profiles to monitor his whereabouts.
AC strongly denied the allegations. She stated the allegations were malicious and in fact it was she who was the victim of domestic abuse and controlling behaviour. Extensive defence evidence was obtained and submitted on AC’s behalf.
During the trial at Maidstone Crown Court, a successful application to dismiss the more serious of charge was successful and the prosecution proceeded with a lesser offence of stalking [section 2A Protection From Harassment Act 1977]. At the conclusion of the trial, the jury unanimously acquitted AC and her good character remains intact.
