GT Stewart represented P, who was acquitted of murder in 1986. The prosecution lodged an appeal against P’s acquittal on the grounds there was new and compelling evidence and that it was in the interests of justice for the case to be re-opened.
Strong representations were made on P’s behalf, arguing that it was not in the interests of justice based on the state of his physical health.
The Court of Appeal refused to re-open the case and quashed the application by the prosecution.
