Whilst representing our client who was accused of criminal damage it became clear that the CPS had failed to follow their own guidance which sets out a 10 point checklist for offences in Children’s homes which sets out the required information before a proper decision can be taken on looked after children (this includes all voluntary arrangements, foster placements and secure training centres). Once this was pointed out to the prosecution they agreed that the case should be dropped.
