Our client was charged along with an adult co-defendant of hitting an elderly victim with stones and a hammer whilst he was walking on a canal towpath. An independent witness claimed that our client kicked the victim as he was struggling on the floor
Our client who turned 18 on the day of the trial maintained that he had not been involved in the incident and had not assaulted the victim. Our client’s good character was in jeopardy as was the job he had just obtained.
The co-defendant pleaded guilty on the morning of the trial after all the witnesses turned up to give evidence and the CPS dropped the case against our client.
