
We represented KT in a two-and-a-half-week trial at the Central Criminal Court, where he was acquitted of causing death by careless driving whilst unfit through cannabis.
The prosecution alleged that KT's driving was grossly impaired due to cannabis, resulting in the tragic collision with a pedestrian. The jury heard extensive evidence about KT's actions immediately afterwards. He drove the injured man straight to hospital, personally performing CPR and attempting to stem bleeding to save his life. KT alleged to have driven dangerously, causing criminal damage to four stationery vehicles. He also collided with a brick wall and a tree approximately 15 minutes after the first collision. Having pleaded to the criminal damage and driving carelessly, the jury found by majority direction that KT was guilty of dangerous driving in respect of the second collision.
After careful cross-examination of the defence case, the jury deliberated for 12 hours. The cross-examination involved Road Traffic Collision experts and a forensic timeline of events. They returned a unanimous not guilty verdict on the most serious allegation: causing death by careless driving whilst unfit through cannabis.
