We represented Mr. K, who was wanted for extradition to Belgium under an Extradition Arrest Warrant requiring him to serve a four-year prison sentence.
We opposed the extradition on the grounds that it would interfere with Mr. K’s right to family life with his wife and young child and that prison conditions in Belgium would violate his Article 3 rights.
We assisted Mr. K in securing legal representation in Belgium to challenge the decisions which had led to his conviction, sentence, and the issuing of the extradition request. By working closely with his Belgian lawyer, we successfully secured the withdrawal of the extradition request.
Our client was represented by John Molleskog, Joint Head of Extradition and Mark Smith from 5 Andrew Hill Chambers.
