GT Stewart act for the tenant Mr Neville. The landlord housing association has just been given permission to appeal in the Court of Appeal. The main argument raised by the Association in this appeal is directed at the correct approach in law in respect of the application of the Equality Act 2010 and in particular sections 15 and 35, at the enforcement stage of a possession case. The case has been identified as being of public importance by Lord Justice Henderson. The appeal will be heard in July 2018. The case in the lower Court is reported in July 2017 Legal Action magazine.
